THE DEADLIEST CATCH TEXT TO WIN SWEEPSTAKES OFFICIAL RULES

NO PURCHASE OR TEXT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. PROMOTION: The Deadliest Catch Text to Win Sweepstakes (the "Sweepstakes") is sponsored by Discovery Communications, LLC, 1 Discovery Place, Silver Spring, MD 20910 (“Sponsor”). The Sweepstakes starts at 12:00:01 AM Eastern Time (ET) on April 11, 2009, and ends at 11:59:59 PM ET on April 14, 2009 (“Promotion Period”). All applicable federal, state and local rules apply. Void where prohibited or restricted by law.

2. ELIGIBILITY: You must be a legal resident of the 50 United States (including the District of Columbia) 18 years or older (or at least the age of majority in the state in which you reside) at time of entry to be eligible to enter. Employees of Discovery Communications, LLC (“Sponsor”) and 3CI (“Sweepstakes Administrator”) (collectively known as “Sweepstakes Entities”) and each of their parent companies, subsidiaries, affiliates, TV production partners, advertising agencies, or promotional suppliers or persons involved in any part of the administration and execution of this Sweepstakes and immediate family member (spouses and parents, children and siblings regardless of where they live) or members of the same households (whether related or not) of any such employees are not eligible to enter.

3. HOW TO ENTER: Entries must be received during each calendar day of the Promotion Period to be eligible for each of the Daily Instant Win Prizes and during the Promotion Period to be eligible for the Grand Prize Drawing. Each calendar day will commence on at 12:00:01 AM ET and will end at 11:59:59 PM ET that same day (or when all Daily Instant Win Prizes have been awarded) over each of the four calendar days during the Promotion Period (each a “Day”). There are two ways to enter the Sweepstakes:

Mobile Phone Entry: To enter via mobile phone you must be an Xbox LIVE Gold or Silver member, and have access to an Xbox360® video game and entertainment system, a “Participating Game” (as described below), and a text messaging capable mobile phone from a participating carrier participating carriers are: AT&T, T-Mobile, Verizon Wireless, Alltel, Virgin, Boost, Nextel, C-Spire Wireless, US Cellular, Rural Cellular, East Kentucky Network, Cellcom, Immix Wireless, Cincinnati Bell and nTelos.

Once you have confirmed that you meet the system requirements, you must find a daily key word. There are two ways to obtain a daily key word: by viewing the Deadliest Catch video on the Xbox LIVE service or by playing one of the Participating Games listed below.

To find the daily key word by viewing the Deadliest Catch Video on the Xbox LIVE service, simply sign-in to the Xbox LIVE service via an Xbox 360 console during the Promotion Period, and then view the Deadliest Catch Video via either “Inside Xbox” (April 11 – April 13) or “Spotlight” (April 14). The daily key word will appear at the end of the video. There will be a different key word each day during the Entry Period.

To find the daily key word by playing one of the participating Xbox 360 video games listed below , simply sign-in to the Xbox LIVE service via an Xbox 360 console, play a multiplayer session of one of the participating Xbox 360 videos games listed below, and, during the game, locate the in-game advertisement for “Deadliest Catch”. There will be a different key word each day during the Entry Period.

Once you’ve obtained a valid daily key word, you can automatically receive one (1) entry by simply texting the key word to “52580” using a text messaging capable mobile phone from a participating carrier (described above).

Standard text message rates apply to each text message sent and received. Free Online Entry: To enter the Sweepstakes online without finding a daily key word and using a mobile phone, visit http://www.3csms.mobi/deadliestcatch/catchpoints/ and complete and submit the online registration form as instructed. Limit of three (3) entries a Day per person/mobile phone/email address regardless of entry method. Entries generated by script, macro or other automated means are void. Normal time, toll, connection and usage rates, if any, charged by your mobile service provider or internet service provider will apply. All entries become the property of the Sponsor and will not be acknowledged. In the event of a dispute as to the identity of an entrant, the authorized account holder of the mobile phone or email address used to enter, as applicable, will be deemed to be the entrant. "Authorized account holder" of a mobile phone is the defined as the natural person in whose name the phone has been issued and to whom services are billed. “Authorized account holder” of an e-mail address is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, ONLINE OR BY SMS (TEXT MESSAGING), OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE SWEEPSTAKES VIA MOBILE PHONE OR A DELAY IN THE PROCESSING OF TEXT MESSAGE OR ONLINE ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SWEEPSTAKES ENTITIES ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY TEXT MESSAGE OR ONLINE ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.

4. PRIZE: One thousand two-hundred and fifty (1,250) Daily Prizes will be awarded, for a total of five thousand (5,000) Daily Prize winners over the four day Promotion Period of 400 Microsoft Points® each (“Daily Prize”) (Approximate Retail Value (ARV) of each Daily Prize is $5.00). Limit of one (1) Daily Prize per person/mobile phone/email address regardless of entry method. One (1) Grand Prize winner will receive 4000 Microsoft Points (ARV: $50.00). Total ARV for all prizes is $25,050.00. No transfer, substitution or cash redemption will be awarded in lieu of stated prize except by Sponsor who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Microsoft Points can be redeemed on the Xbox LIVE service or by going to xbox.com, signing in and selecting “My Account” from the drop down menu, and then clicking on “Add Microsoft Points”.

5. INSTANT WIN/GRAND PRIZE DRAWING/WINNER NOTIFICATION: One thousand two-hundred and fifty (1,250) winners (“Daily Winners”) will be selected at random throughout each Day during the Promotion Period from among all eligible entries received for that Day, for a total of five thousand (5,000) winners over the four day Promotion Period. For each entry received, as recorded by the Sweepstakes database, the computer’s random selection program will randomly assign each entrant one number from 1-100, with a winning number(s) randomly pre-determined for each Day selected prior to the start of each Day. If an entry is matched with the winning number the entrant will be the potential winner of the Instant Win Prize. Each Day will automatically end as soon as all the Daily Prizes have been awarded on any applicable Day. In the event there are less daily entries received in any Day than Daily Prizes to be awarded, the remaining Daily Prizes will be added to the number of Daily Prizes awarded in the succeeding Day of the Promotion Period, if any. If there are less Daily Entries received during the Promotion Period than Daily Prizes to be awarded, those remaining Daily Prizes will not be awarded. Each of the Daily Prizes is randomly awarded throughout the applicable Day, regardless of the method of entry. The odds of winning a Daily Prize is estimated at 1:25. Winners who entered via mobile phone will be notified via SMS message to the phone number from which they texted the daily key word and winners who entered online will receive an email to the email address provided on their registration form and will be provided with instructions on how to claim their Daily Prize. If the notification to a Daily Winner is returned as undeliverable, or a Daily Winner does not respond for any reason the Daily Prize will be forfeited.

One (1) Grand Prize winner will be selected in a random drawing on or about 4/20/09 from among all eligible entries received during the Promotion Period. Odds of winning the Grand Prize will depend upon the number of eligible entries received during the Promotion Period. Winners who entered via mobile phone will be notified via SMS message to the phone number from which they texted the daily key word and winners who entered online will receive an email to the email address provided on their registration form and will be provided with instructions on how to claim their Grand Prize. If a Grand Prize winner notification is returned as undeliverable, or the Grand Prize Winner does not respond for any reason the Grand Prize will be forfeited and the Sponsor will award the prize to an alternate randomly selected Grand Prize winner.

6. GENERAL: Taxes on prizes and all expenses related to acceptance and use of prizes and not specified are the sole responsibility of winners. By entering the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Sponsor which shall be final and binding in all respects. By participating in this Sweepstakes and/or by accepting any prize that they may win, entrant agrees for entrant and for entrant’s heirs, executors, and administrators (i) to release the Sweepstakes Entities and Microsoft Corporation (“Microsoft”) and each of their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Sweepstakes and/or acceptance or use of any awarded prize, (ii) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes, and (iii) that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize. Entry constitutes permission (except where prohibited by law) to use winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification, permission or approval.

7. WAIVER: Released Parties are not responsible for any technical, mechanical, printing, typographical, human or other error or any kind relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in the administration of the Sweepstakes, the processing of entries, the announcement of the prize or any Sweepstakes-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual’s ability to participate. Sponsor reserves the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award any prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. Sponsor is not responsible for any failure to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor or other “force majeure” event.

8. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant, Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Maryland. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in Maryland, and each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of Maryland. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

9. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to Sponsor’s privacy policy posted at http://dsc.discovery.com/utilities/about/privacypolicy.html.

10. OFFICIAL RULES AND GRAND PRIZE WINNER: For a copy of these Official Rules, (or the name of the Grand Prize Winner, available after 4/27/09 ), mail a self-addressed, stamped envelope to “The Deadliest Catch Text to Win Sweepstakes” Winner's List or Rules, Pop2Life, 247 Centre Street, 6th Floor, New York, NY 10013. (VT residents may omit return postage). Requests must be received by 05/15/09.
